These Terms of Service govern your use of rawbalance.com.au and any purchase of products, digital content or services from RAWBALANCE.

RAWBALANCE is operated by Matias Wisteihn Kure, ABN 98 651 243 322. References to “RAWBALANCE”, “we”, “us” or “our” mean Matias Wisteihn Kure trading as RAWBALANCE.

Our online store is hosted by Shopify.

Please read these Terms before using our website or placing an order. By placing an order, you agree to these Terms and the policies referred to in them. Your use of the website is also subject to the applicable website-use provisions of these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Eligibility and Minors

You must be at least 18 years old or have the involvement and permission of a parent or legal guardian to place an order.

RAWBALANCE products may be used by people of different ages and ability levels. Children and anyone who cannot safely assess and manage the risks of balance training must use the product under appropriate adult supervision.

A parent, guardian, coach, facility operator or supervising adult is responsible for determining whether the product and activity are appropriate for the individual user.

2. Product Information

We take reasonable care to ensure that product descriptions, images, specifications, prices and availability information are accurate.

Colours, textures and minor visual details may appear differently depending on the customer’s screen. Wood is a natural material, so products may have reasonable variations in grain, colour and appearance. These natural variations are not necessarily defects.

Such variations do not affect your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.

We may update product descriptions or discontinue products. Changes will not retrospectively alter the material terms of an order we have already accepted.

RAWBALANCE is training equipment. It is not a toy, medical device or substitute for professional healthcare.

3. Safe Product Use

Balance training involves an inherent risk of losing balance and falling. Users are responsible for exercising reasonable care and using the product in accordance with supplied instructions and warnings.

Before use:

  • Check the board, ball and surrounding area for damage, moisture, debris or hazards.

  • Use the product on a stable, level and suitable surface.

  • Ensure there is sufficient clear space around the user.

  • Remove nearby sharp, fragile or dangerous objects.

  • Begin near a stable support, wall, rail or with appropriate assistance.

  • Wear suitable clothing and footwear, or follow the product instructions concerning barefoot use.

  • Select exercises appropriate for the user’s age, experience, health and ability.

The product may be used indoors or outdoors. Outdoor use should only occur on a dry, level, stable and suitable surface. Do not use the product on wet, slippery, unstable, sloped or hazardous surfaces or near traffic, stairs, pools, open edges or other dangerous areas.

Do not:

  • Use a damaged, cracked, excessively worn or wet product.

  • Intentionally jump onto, throw, modify or misuse the product.

  • Use the product under the influence of alcohol, recreational drugs or any substance that impairs balance or judgement.

  • Attempt movements beyond the user’s current ability or contrary to supplied instructions.

  • Continue using the product if the user experiences pain, dizziness, numbness, unusual discomfort or loss of control.

Stop using the product immediately if it appears damaged or unsafe and contact RAWBALANCE.

Nothing in this section excludes liability that cannot lawfully be excluded.

4. Health, Injury and Training Information

Content provided through our website, social media, digital materials, courses, emails or customer support is general product-use, training and educational information.

It is not medical advice, physiotherapy services in Australia, diagnosis, treatment, rehabilitation or emergency care.

RAWBALANCE may provide general personalised information based on details voluntarily provided by a customer. Information may be prepared or reviewed by someone with relevant education or qualifications outside Australia. This does not mean that RAWBALANCE is providing services from an Australian-registered physiotherapist or another Australian-registered healthcare practitioner.

You should consult an appropriately qualified and registered healthcare professional before using the product if you:

  • Have a current or previous injury.

  • Experience ongoing pain, instability or limited movement.

  • Have a medical condition that may affect balance or exercise.

  • Are pregnant.

  • Have been advised to avoid or modify physical activity.

  • Are uncertain whether balance training is appropriate for you.

In an emergency, contact the appropriate emergency service.

Health and injury information submitted to us is handled in accordance with our Privacy Policy.

5. Professional and Commercial Use

RAWBALANCE products may be used in homes, gyms, sporting organisations, educational facilities, clinics and other appropriate settings.

A coach, trainer, employer, club, school, facility operator or other professional user is responsible for:

  • Assessing whether the product is suitable for its intended environment and participants.

  • Providing competent supervision where appropriate.

  • Conducting any workplace, facility or activity risk assessments required by law.

  • Ensuring users receive suitable instructions and warnings.

  • Inspecting the product regularly.

  • Complying with applicable health, safety, professional and insurance requirements.

Permission to use the product in a professional or commercial setting does not mean that RAWBALANCE certifies a particular training program, facility or professional service.

Resale, distribution or export for resale is not permitted without our prior written agreement.

6. Orders and Contract Formation

When you submit an order, you offer to purchase the selected products or services on these Terms.

An automated order confirmation acknowledges that we have received your order. We accept the order when we confirm it for fulfilment or dispatch, unless acceptance occurs earlier under applicable law.

We may decline or cancel an order before dispatch where reasonably necessary, including because:

  • A product is unavailable.

  • Payment cannot be authorised.

  • Order information appears incorrect or incomplete.

  • We reasonably suspect fraud, unauthorised activity or resale.

  • There is an obvious pricing or description error.

  • We cannot deliver to the supplied address.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion to the original payment method. This does not limit any other rights available under applicable law.

You are responsible for ensuring that your contact, delivery and order information is accurate.

7. Prices and Payment

Unless stated otherwise:

  • Prices displayed on rawbalance.com.au are in Australian dollars.

  • Applicable delivery charges and other mandatory charges will be displayed before you complete the purchase.

  • You authorise the applicable payment provider to charge the total amount shown at checkout.

Prices and promotions may change before an order is placed. A subsequent price reduction does not create an entitlement to a partial refund unless required by law or expressly included in the promotion.

We may correct an obvious pricing error. If an obvious error affects an order already submitted, we will contact you and give you the option to proceed at the correct price or receive a refund.

Discount codes and promotions may have additional conditions, including expiry dates, eligible products and limits per customer. Unless expressly stated, promotions cannot be combined.

8. Order Changes and Cancellations

Contact us as soon as possible at info@rawbalance.com.au if you need to change or cancel an order.

We cannot guarantee that an order can be changed or cancelled after it has entered fulfilment or been dispatched.

If an order has already been dispatched, you may request a return after delivery in accordance with our Returns & 100-Day Money-Back Guarantee.

9. Shipping and Delivery

Orders are shipped in accordance with our Shipping Policy.

Delivery dates are estimates unless we expressly agree to a guaranteed delivery date. Delays may occur because of carrier disruption, severe weather, incorrect address information, remote delivery conditions or other circumstances outside our reasonable control.

We will not treat an estimated delivery date as a guaranteed date, but this does not exclude any rights or remedies available under the Australian Consumer Law.

Risk of loss or damage remains with RAWBALANCE until the order is delivered to:

  • The delivery address supplied with the order;

  • A location authorised by the customer; or

  • A collection point selected or authorised by the customer.

Where you provide authority to leave, the parcel may be left at the authorised location in accordance with the carrier’s procedures. You are responsible for ensuring that the selected location is reasonably safe and suitable.

Contact us if tracking shows that an order has been delivered but you cannot locate it, or if the parcel arrives damaged.

10. Returns and Refunds

Eligible returns are governed by our Returns & 100-Day Money-Back Guarantee.

The voluntary 100-Day Money-Back Guarantee is additional to, and does not replace or restrict, your rights under the Australian Consumer Law.

For faulty, unsafe, incorrectly supplied or materially misdescribed products, remedies will be provided in accordance with applicable consumer law.

11. Five-Year Warranty

Where a product is advertised as including a five-year warranty, the warranty is provided subject to our applicable Warranty Policy.

Any voluntary warranty offered by RAWBALANCE operates in addition to rights and remedies that cannot be excluded under the Australian Consumer Law.

Warranty coverage does not automatically extend to damage caused by misuse, unauthorised modification, failure to follow product instructions, avoidable water or weather exposure, improper storage or ordinary wear and tear. These exclusions do not apply where they would unlawfully restrict a consumer’s statutory rights.

12. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

13. Digital Content, Courses and Training Materials

Your purchase may include or provide access to digital training materials, videos, guides, programs, courses or other content.

Unless expressly stated otherwise:

  • Access is provided to the purchasing customer for personal or internal professional use.

  • Digital content must not be copied, resold, sublicensed, publicly distributed, uploaded to another platform or shared with unauthorised users.

  • Exercise demonstrations and programs must be adapted to the individual user’s ability, health and environment.

  • Results vary between individuals and are not guaranteed.

  • Digital content does not constitute medical advice, diagnosis, treatment or physiotherapy services in Australia.

  • We may make reasonable updates to digital content to improve safety, accuracy or functionality.

Technical availability may occasionally be interrupted for maintenance, updates or circumstances outside our reasonable control. This does not exclude any consumer rights applying to paid digital products or services.

14. Results and Performance Claims

Individual results from using RAWBALANCE vary depending on factors including training frequency, technique, experience, sport, physical condition and other training activities.

Testimonials, demonstrations and examples describe individual experiences or illustrate possible uses. They do not guarantee that every customer will achieve the same result.

Nothing on our website should be interpreted as a guaranteed sporting, medical, rehabilitation or injury-prevention outcome unless we expressly state a guarantee and provide its applicable terms.

15. Reviews, Photos and Customer Content

If you submit a review, testimonial, photo, video or other content, you confirm that:

  • The content is truthful and based on your genuine experience.

  • You own the content or have permission to submit it.

  • It does not infringe another person’s intellectual property, privacy or other rights.

  • It is not unlawful, defamatory, misleading, abusive or malicious.

  • You have disclosed any reward, discount, free product or other incentive connected with the submission.

You grant RAWBALANCE a non-exclusive, worldwide, royalty-free licence to display, reproduce and use submitted content for operating and promoting RAWBALANCE.

We will obtain any additional permission required by law before using your identifiable image or testimonial in paid advertising where the original context does not provide sufficient permission.

You may contact us to request that we stop using customer content. We will consider the request and take reasonable action, subject to material already lawfully produced, published or required to be retained.

We may decline, moderate or remove content where reasonably necessary, but we do not promise to publish every submission.

16. Intellectual Property

The website and its original content, branding, designs, graphics, photographs, videos, training materials and other materials are owned by or licensed to RAWBALANCE and are protected by applicable intellectual property laws.

You may access the website and download or view purchased materials for their permitted personal or internal professional use.

Without prior written permission, you must not:

  • Copy, reproduce or commercially exploit our content.

  • Republish or distribute our paid training materials.

  • Use RAWBALANCE branding in a way that suggests endorsement, partnership or affiliation.

  • Remove copyright, trademark or ownership notices.

  • Scrape, extract or systematically collect website content or customer information.

  • Use our content or branding for unlawful or misleading purposes.

Third-party names, logos and materials remain the property of their respective owners.

17. Acceptable Website Use

You must not use the website or services to:

  • Break applicable law.

  • Commit fraud or provide deliberately false information.

  • Infringe another person’s rights.

  • Upload malware or interfere with website security.

  • Access restricted areas without authorisation.

  • Collect personal information about others without permission.

  • Send spam or malicious communications.

  • Harass, threaten or abuse another person.

  • Place orders for unauthorised resale.

  • Use automated systems to damage, overload or improperly extract data from the website.

We may restrict access, cancel fraudulent activity or take other reasonable action where these conditions are violated.

18. Third-Party Services and Links

Our website may use or link to services operated by third parties, including Shopify, payment providers, social media platforms and delivery providers.

Third-party services may have their own terms and privacy policies. RAWBALANCE is not responsible for the independent content or operation of a third-party website that we do not control.

This does not exclude responsibility for third-party providers where RAWBALANCE remains responsible under applicable law.

Purchases made through rawbalance.com.au are transactions between the customer and RAWBALANCE. Shopify provides the ecommerce platform but is not the seller of RAWBALANCE products.

19. Website Availability and Information

We take reasonable care when maintaining the website but cannot guarantee that it will always be uninterrupted, error-free or free from harmful code.

General website content may be updated from time to time. If we discover a material error affecting an accepted order, we will contact the affected customer and provide an appropriate solution.

General educational content may not remain current indefinitely and should not be relied upon as professional, medical, legal or financial advice.

20. Liability

Nothing in these Terms excludes, restricts or modifies:

  • Rights or remedies under the Australian Consumer Law that cannot lawfully be excluded;

  • Liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded; or

  • Any other statutory right or remedy that cannot be limited by agreement.

To the extent permitted by law, RAWBALANCE is not responsible for loss that:

  • Was not reasonably foreseeable;

  • Was not caused by a breach by RAWBALANCE;

  • Results from use that materially conflicts with supplied instructions or warnings;

  • Results from an unauthorised alteration or intentional misuse of the product; or

  • Is a business loss arising from a consumer purchase, except where applicable law provides otherwise.

Every user remains responsible for exercising reasonable care and selecting activity appropriate to their abilities. This does not excuse RAWBALANCE from responsibility for a defective or unsafe product, misleading information, negligence or another matter for which liability cannot lawfully be excluded.

21. Suspension and Termination

We may suspend or restrict access to website features where reasonably necessary to:

  • Protect the website, customers or third parties.

  • Investigate suspected fraud or unlawful activity.

  • Address a material breach of these Terms.

  • Comply with a legal obligation.

Termination of website access does not affect an accepted order, accrued rights, payment obligations, consumer rights or provisions that are intended to continue after termination.

22. Privacy

Personal information is handled in accordance with our Privacy Policy.

The Privacy Policy explains how we collect, use, disclose and protect personal information, including information voluntarily provided in health or injury-related enquiries.

23. Changes to These Terms

We may update these Terms to reflect changes to our products, operations or legal obligations.

The current version will be published on this page with an updated date. Material changes will apply prospectively unless the law permits or requires otherwise.

Changes will not retrospectively remove rights relating to an order already accepted.

24. Governing Law

These Terms are governed by the laws of New South Wales and the applicable laws of Australia.

The parties submit to the courts with jurisdiction in New South Wales. However, nothing in this section prevents a consumer from relying on mandatory rights or bringing a claim in another jurisdiction where applicable law permits them to do so.

25. General Provisions

If part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply.

A failure or delay in enforcing a provision does not waive the right to enforce it later.

These Terms, together with the policies and order information incorporated into them, form the agreement relating to your use of the website and purchase.

If there is an inconsistency, mandatory law takes priority. For privacy matters, the Privacy Policy applies. For a specific promotion, the clearly disclosed promotional terms apply to that promotion.

We may transfer our rights and obligations as part of a genuine sale or restructuring of the RAWBALANCE business, provided this does not reduce an existing customer’s rights.
